Users registering at the Yudiz.com site are requested to provide some personally identifiable information which becomes the property of Yudiz.com and can be shared, disclosed or distributed to third parties only in accordance with the Privacy Policy. It must be clarified here that registration is not required for visitors to the site who do not require any specific services.

Yudiz.com will not sell or rent such personally identifiable information collected. The personally identifiable information is supplied voluntarily for some of the following purposes:

Registration Data & Other Optional Information

If you are merely a visitor to our site then Yudiz.com does not collect any personal information about you, except to the limited extent through the use of cookies, as described below. If you decide to use certain services offered on the site, you will be asked to register on registration link. During registration you will be requested to complete a registration form setting out basic online contact information about yourself. Such information includes Name, Email ID, skype ID, Company name, Contact Number.

E-mail Information

When we receive e-mails from you, we may retain the content of any e-mail messages sent to us, as well as details of your e-mail address.

Use of Web-Based Tracking Mechanisms such as Cookies

Yudiz.com gives you the choice regarding the collection and usage of your personally identifiable information. During registration for “joining our mailing list,” we request for contact information in order to send bulletins and for advertising purposes. Again, it is not necessary for you to register in order to access and use our Site. You may therefore choose to opt out of providing such information.

Further, once you are registered at the Yudiz.com site, you will have the option at any stage to inform us that you no longer wish to receive future e-mails and you may “unsubscribe” by contacting on unsubscribe@yudiz.com.

4. Our Role as a Software Development Service Provider

Yudiz.com works only as an independent software development service provider. We design and build software, mobile applications, games, websites and digital platforms (together, “Solutions”) for our clients, and deliver them according to the scope of work set out in the agreement with each client. Once a Solution is delivered and handed over, the client fully owns, hosts, operates, manages and uses it, and is solely responsible for it.

Except as stated below, after delivery Yudiz.com has no association with the Solution or with the client’s business in any form. Specifically:

• No ownership or operation: Yudiz.com does not own, operate, control, manage, endorse or promote any platform or software developed for its clients.
• No role in the client’s business: Yudiz.com takes no part in, and is not responsible for, the business model, operations, services, content, transactions, pricing, marketing or user management of any Solution.
• Legal compliance is the client’s responsibility: The client alone must make sure that the Solution and its business follow all applicable laws, regulations, licences and government approvals, including any rules on gaming, finance, payments, data protection, advertising and consumer protection.
• Queries and disputes: Any query, complaint, claim or dispute about how a Solution operates, including its services, data handling, or payments and refunds made by end users on that platform, should go directly to the client or business that owns that platform.
• No liability: Yudiz.com is not liable, directly or indirectly, for any loss, damage, claim, penalty, or legal or criminal liability arising from the operation, use, misuse or business of a Solution developed for a client, or from any change the client or a third party makes to it after delivery.
• Indemnity: The client agrees to indemnify Yudiz.com and hold it harmless against any claim, action or proceeding by any end user, authority or third party that arises from the client’s Solution or business.

If Yudiz.com has separately agreed in writing to provide maintenance or support for a Solution, that work is limited to the scope of, and governed solely by the terms of, that written agreement.

5. Payment, Refund and Cancellation Policy

Every engagement with Yudiz.com is governed by a written agreement signed by both Yudiz.com and the client. The payment, refund and cancellation terms in that agreement are specific to each project and may differ from client to client.

Payment Terms

• The payment terms for each project are set out in that project’s agreement. These include the project cost, payment schedule, milestones, advance payments, mode of payment, currency, applicable taxes and invoicing terms.
• All payments must be made on or before the due dates stated in the agreement or invoice.
• Applicable taxes, bank charges and payment gateway charges are payable by the client, unless the agreement states otherwise.
• If a payment is delayed, Yudiz.com may pause or suspend work, withhold deliverables, or end the engagement as provided in the agreement. Any resulting delay in the timeline is not Yudiz.com’s responsibility.
• Source code, deliverables and intellectual property rights are transferred to the client only after all payments due under the agreement are received in full, unless the agreement states otherwise.

Cancellation Terms

• Either party may cancel or end an engagement only as permitted by, and in the manner set out in, the agreement for that project. This includes any notice period it requires.
• Cancellation requests must be made in writing.
• If a project is cancelled, the client must pay for all work completed and all costs incurred up to the effective date of cancellation, along with any cancellation charges set out in the agreement.
• If the client cancels a project, puts it on hold, or stops responding for the period stated in the agreement, Yudiz.com may treat the project as cancelled by the client.

Refund Terms

• Refunds, if any, are governed solely by the terms in the agreement for that project.
• No general or standard refund applies unless the agreement expressly provides for one.
• Advance payments, and payments for work already completed or delivered, are non-refundable unless the agreement expressly states otherwise.
• Any refund approved under the agreement will be processed through the original mode of payment, within the timeline stated in the agreement or, if none is stated, within a reasonable time.

Agreement Shall Prevail

If anything in this Policy conflicts with the agreement signed between Yudiz.com and the client, the agreement prevails.

6. Security Practices

As per the I.T. Act, 2000 and Rules of the I.T. Act, 2000 (upgraded as per amendments in the I.T. Act, 2000 and its rules)

Yudiz.com has implemented stringent, internationally acceptable standards of technology and operational security in order to protect personally identifiable information from loss, misuse, alteration or destruction. The data resides behind a firewall, with access restricted to authorized Yudiz.com personnel. IDS, IPS and other state of the art security solutions through third party data center servers for a secured user experience.

Yudiz.com has implemented “Reasonable Security Practices” as required by the Information Technology Act, 2000 rules including any amendment in the said Act and rules. By complying with such provisions, Yudiz.com assures proper care and control over its I.T. and Security operations under sections 43, 43A, 45 & Section 85 of I.T.Act, 2000 including related rules.

By using this site you agree that Yudiz.com shall not be held responsible for any uncontrollable security attack and in such cases you agree that Yudiz.com shall not be held responsible for any type of financial, opportunity, legal, business and reputation losses that may occur to you under the Provisions of Section 43, 43A and 45 of Information Technology Act, 2000 and including any amendments in the said Act.

You further agree that Yudiz.com management shall not be held responsible directly or indirectly for any cyber crime related criminal liabilities under I.T.Act,2000 relating to your information as you agree and acknowledge that management of Yudiz.com complies with due diligence requirements of I.T.Act,2000 including its rules and amendments.

Children’s Privacy

We are very sensitive to the children privacy. If you come to know that your child has given wrong age information on Yudiz.com then please contact support@yudiz.com to remove such data.
